These terms and conditions apply to all orders placed by the customer (referred to as “you” or “your”) with Masters of Martial Arts ProShop (“Seller” “us” or “we”), at https://mma-proshop.mymawebsite.com (“website”).
For the purposes of NEST Payment Processing (as defined below) only, you are contracting with NEST Management Limited, a limited liability company registered in England with its registered office at Unit 3.2 Wilford Business Park, Ruddington Lane, Nottingham NG11 7EP (“NEST”).
Please read these Terms and Conditions carefully before placing any orders on the website. By placing an order, you agree and accept these Terms and Conditions.
We may modify these Terms and Conditions occasionally, should you not agree with the Terms and Conditions or are unclear with any aspect please contact us. Our contact details can be found on our website. If your query relates to NEST Payment Processing, please contact us on email@example.com. Any changes made after you have placed an order will not affect that order unless we are required to make the change by law.
We make every effort to display accurate stock availability on the website but stock levels are subject to change without notification.
Please note that all orders are subject to availability. Should the goods you order not be in stock we will dispatch your item as soon as we are able to source the required item. In the event that we are unable to source the item you have order within a reasonable period of time we will contact you and offer you a full refund.
Before completing an order you can review your order including total price and shipping charges. Once you submit your order by pressing confirm in checkout you have agreed to pay the total amount due and have agreed to these terms and conditions.
Payment for goods is made online via Worldpay using MasterCard, VISA and Maestro.
Payment for your order is taken at the time your order is placed. The currency used is in British Pounds (£/GBP). VAT is included in all our prices.
You are required to provide payment details that are valid and correct and you confirm that you are the person referred to in the billing information provided.
Payments are collected by NEST on the Seller’s behalf during the checkout procedure and NEST undertakes to pass your payment onto the Seller on your behalf. Refer to NEST Payment Processing below for further details.
After placing your order you will receive an automated acknowledgement. Please note that this does not mean that your order has been accepted. All orders are subject to acceptance by the Seller. You will receive an email confirming that the Seller has accepted your order when your order and been processed and is ready for delivery by the Seller.
We aim to deliver orders as quickly as possible so once your order has been placed we may be unable to make changes to your order. If you wish to change a placed order you must contact us as soon as possible at firstname.lastname@example.org.
All prices are displayed in British pounds (£/GBP). All prices exclude delivery fees which will be added in checkout and will differ based on which country your order is shipped to. You can select shipping country in checkout.
If you are placing an order using a card which is not denominated in British pounds (£/GBP) your card issuer will calculate the applicable exchange rate to process the transaction. We and/or NEST are not responsible for any exchange rates.
Any customs or import duties are charged once a parcel reaches the destination country. Any additional charges must be paid by the recipient of the parcel. Unfortunately we do not have any control over these charges and advise you contact your local customs office for current charges before placing the order.
We will dispatch approved orders as quickly as possible. Delivery times vary depending on country and certain postcodes within the UK. We cannot be held responsible for any delays caused by destination customs clearance processes.
If we are unable to dispatch all or part of an order due to stock or other reasons, we will inform you as quickly as possible. In this case, you will be able to cancel the order and a refund for the full order amount, including shipping will be provided to you.
If you have asked to collect your order from our premises, we will confirm by email when your order is ready to be collected.
If for any reason you are unhappy to the item(s) you have ordered you have the right to cancel. In the event that you cancel an order before the goods have been dispatched to you, we will give you a full refund of any monies paid within 10 days of receipt of notification from you that you wish to cancel your order.
In the event that you cancel an order after the goods have been dispatched to you we will refund the value of the goods to you within 10 days of your having returned the goods to us in an undamaged, unused and re-saleable condition, in the original packaging and with all tags and labels intact. You will need to return the goods by post or in person. You have the right to cancel your order in writing within 14 days of delivery/receipt of the goods.
If you are not entirely happy with your order you can return the goods to us within 28 days of receipt. We will be happy to offer you an exchange or a refund provided that the goods are returned in an undamaged, unused and re-saleable condition, in the original packaging and with all tags and labels intact. If we feel that the item returned is not of a saleable condition, no refund will be granted.
For hygiene reasons we do not accept the return of any groin guards or gum shields. This does not affect your statutory rights.
Please email Us at email@example.com to claim a returns or exchange address label and state a reason as to why you are returning or exchanging the item(s).
It is your responsibility to make sure returned orders reach us, so we advise that you obtain a proof of return from the post office.
We aim to process all refunds within 14 days of receipt of goods. NEST will process any online payment of refunds on our behalf. Online payment refunds will be credited to the original payment method used. Refunds will not include the original delivery charge paid.
You will be notified by NEST via e-mail once your return has been processed.
In the event that we fail to respond to a request for a refund either by refunding or denying the refund request, NEST may execute the refund on our behalf (please refer to NEST Payment Processing below).
If you receive a faulty item please contact Us so we can arrange for the items to be returned.
Our card payment services are processed by NEST who act as our limited agent for the purposes of using third party payment service providers to collect payments for goods made online and pass those payments onto us.
NEST Payment Processing allows us to (a) accept payment by authorised credit and debit card transactions, (b) have those funds credited to our payment account with NEST, and (c) have those funds deposited into our designated bank account.
We agree that any payment made by you to NEST will be considered the same as a payment made by you directly to us, and we will sell the ordered goods to you as if we had directly received the payment from you, regardless of whether we have received the payment from NEST.
In the event that we fail to honour a refund that you believe is due under our refund policy (as set out above in these terms and conditions), you may request that NEST initiate a refund by contacting NEST on firstname.lastname@example.org NEST will review the facts and circumstances and determine whether or not a refund is due in accordance with our refund policy. NEST will endeavour to complete its review within 30 days of being contacted by you. All determinations by NEST with respect to refunds shall be final on both you and the Us.
Every effort has been made to accurately display products and colours on the website however colours can display differently due to your computer.

These Terms and Conditions and any dispute or claim arising about of or in connection with it shall be governed by and construed in accordance with the law of England and Wales.
